Intellectual Property

All artwork, photographs, images, text, logos, graphics, and website content are the intellectual property of A. Adilia R. Cunha (AARCworks) unless otherwise stated.

The purchase of an original artwork or print does not transfer copyright or reproduction rights. Artwork may not be copied, reproduced, distributed, published, scanned, modified, used commercially, or used to create derivative works without prior written permission from the artist.

Artwork Representation

Every effort is made to represent each artwork as accurately as possible through photographs and descriptions.

Please note that colours may appear slightly different depending on your screen settings, lighting conditions, and device display.

Because every original painting is created by hand, natural variations in texture, brushwork, and surface detail are part of the artwork's character and are not considered defects.

Pricing & Availability

Artwork prices and availability are subject to change without notice.

An artwork is not considered sold until payment has been successfully processed. In the rare event that an item becomes unavailable after purchase, you will be contacted promptly and issued a full refund.

Orders & Payment

Orders are processed after payment has been received and confirmed.

AARCworks reserves the right to refuse or cancel an order in cases of payment issues, pricing errors, suspected fraud, or other unforeseen circumstances. If an order is cancelled after payment has been received, a full refund will be issued.

Shipping & Returns

Shipping, delivery timelines, cancellations, damaged shipments, and refunds are governed by the Shipping Policy and Return Policy available on this website.

Commissioned Artwork

Commissioned artwork is governed by a separate Commission Agreement provided before work begins.

Where a Commission Agreement differs from these Terms & Conditions, the Commission Agreement will take precedence.

Limitation of Liability

To the fullest extent permitted by applicable law, AARCworks shall not be liable for indirect, incidental, consequential, or special damages arising from the use of this website or the purchase, delivery, or use of artwork.

Nothing in these Terms & Conditions limits rights that cannot legally be excluded under applicable consumer protection laws.

Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Manitoba and the applicable laws of Canada.

Changes to These Terms

AARCworks reserves the right to update or modify these Terms & Conditions at any time. Any changes will take effect immediately upon being published on this website.
